BY PROVIDING INFORMATION TO US ON THIS WEB SITE, YOU CONSENT TO THE COLLECTION, USE AND DISCLOSURE OF THAT INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY.

PierPASS("PierPASS," "us," or "we") respects the privacy concerns of visitors to this Web site. We are proud of our information practices, and we want you to know the steps we take to protect the information you may provide to us. This Privacy Policy is effective as of June 1, 2005, and applies only to the information we collect on this Web site.
  1. Changes to This Privacy Policy
  2. We may modify, alter or update this Privacy Policy at any time by updating this page. If we make any modifications to this Privacy Policy that are material, we will notify you by e-mail (at the e-mail address contained in your most recent registration form) that an updated Privacy Policy is available on our website.   3. Information We Collect Automatically

The purpose of our website is to enable users to track information with respect to cargo, such as the name of the marine terminals which cargo has entered or exited, the date and time of entry or exit, the vessel name and voyage number with respect to such cargo, the Traffic Mitigation Fee assessed with respect to such cargo and payment status of such fee, the size and number of containers in which such cargo is transported, the container number(s), and the bill of lading or booking number with respect to such cargo or container(s) (the "Business Information"). Such Business Information may be provided by the users or by the marine terminal operators. By using this website, each user acknowledges and agrees that such Business Information does not constitute User Information, as referred to in paragraphs 3 through 5 below, and will be accessible with respect to its own cargo by all other users of this website, and consents to the collection of such Business Information by PierPASS (whether collected from the users of this website or the marine terminal operators) and the disclosure thereof to any other user of this website.

    In addition, the Internet servers that run our Web site collect certain non-business information about your visits to our Web site. The non-business information that we may collect includes the name of the domain and host from which you access the Internet, the type of operating system you use (e.g., Macintosh or Windows), the type of Internet browser you use (e.g., Netscape or Internet Explorer), the IP address of your computer, the date and time you access the Web site, and the Internet address of the Web site from which you link to our Web site. We use this non-business information to analyze trends, administer our Web site, and gather broad demographic information for aggregate use. If you submit User Information as indicated below, we will link such User Information to the non-business information we automatically collect to try to improve your experience on our Web site.

  5. Information You Choose to Provide to Us

PierPASS gathers and retains personal or other information about you that may be linked to information we automatically collect only when you voluntarily submit such information (such information is referred to herein as "User Information"). For example, if you choose to complete and submit the registration form, we will receive User Information such as your name, company name, company address, company phone number and your work e-mail address. In addition, if you choose to make payment for the release of cargo through our website, we will collect your bank account information, credit card number or debit card number, as applicable, and billing address. This User Information will be retained by us for our records and will also be linked to the information that we automatically collect. We will use any User Information you submit to us to: (a) send information to you about services and system changes that we think may be of interest to you; (b) send notices to you regarding container availability or other types of notices requested by you; (c) send customer satisfaction surveys; and (d) enhance our services and better meet the needs and preferences of our customers. If you desire to not receive any or all of the above information, you may contact us at info@pierpass.org and we will remove you from the requested lists. If we change the manner we use or retain such User Information you provide to us, we will update this Privacy Policy. 6/7/2005

  7. User Information as an Asset of PierPASS
  8. The User Information you provide to us is an asset of PierPASS. If PierPASS or a substantial part of our business is sold or otherwise transferred to a third party, your User Information may be transferred as well. We will notify you of any transfer of your User Information in connection with such a major transaction.

  9. Disclosure of User Information to Third Parties
  10. Except for a major transaction as described above, PierPASS will not sell or rent the User Information you provide to us to any third party without first obtaining your consent. In addition, we will not disclose the User Information you provide to us without your consent except: (a) as required by law; (b) to our service provider who hosts and maintains this Web site; and (c) to service providers or suppliers if the disclosure will enable that party to perform business, professional or technical support for us.

  11. Cookies
  12. "Cookies" are small pieces of information that are stored by your browser on your computer's hard drive. We use cookies in a number of ways. For example, we use cookies to track the total number of visitors to our Web site on an aggregate basis and to track your company's use of this Web site. If you provided User Information to us, we will link such User Information to a cookie. Most Web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future.

  14. We maintain physical, electronic, and procedural safeguards to protect your User Information. We follow generally accepted industry standards to safeguard your User Information including use of the Secure Sockets Layer Protocol (SSL) when you submit User Information on our "TMF Payment" page. You should be aware, however, that no transmission over the Internet, and no electronic data storage method, is 100% secure. Therefore, we cannot guarantee the absolute security of the User Information you provide to us either during its transmission or its storage on the servers we use for this Web site.

  16. PierPASS does not endorse and is not responsible for the information practices or privacy policies of Web sites operated by others that may be linked to our Web site.   18. It is not our intention to collect User Information from anyone under 18 years of age. If you are under 18 years of age, you may use this Web site only with the participation of an adult.
